Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Probation360 mobile application ("App"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the App.

We may update these Terms from time to time. We will notify you of material changes through the App or by email. Your continued use after changes means you accept the new Terms.

2. Description of Service

Probation360 is a reminder and tracking tool designed to help individuals on probation or parole manage their daily check-ins, schedules, and progress. The App may:

  • Send reminders about UA hotline check-ins (color codes, PIDs, etc.)
  • Log your check-in history and results
  • Track progress toward completing probation requirements
  • Provide a centralized place to store probation-related information

Important: Probation360 is a private company. We are not a government agency, not affiliated with any court, probation department, or law enforcement. The App does not replace your probation officer, attorney, or any official communication.

3. No Legal, Medical, or Professional Advice

Probation360 provides no legal, medical, or professional advice. The App is an organizational tool only. It does not:

  • Provide legal counsel or representation
  • Guarantee compliance with your probation terms
  • Replace communication with your probation officer, attorney, or treatment provider
  • Guarantee any specific court outcome or result

You are solely responsible for meeting all your probation requirements. Always verify your obligations directly with your probation officer or court.

4. User Responsibilities

By using Probation360, you agree to:

  • Be responsible for your compliance. You must make all required calls, tests, and appointments on time—the App is only a reminder tool.
  • Keep your information accurate. You are responsible for entering correct hotline numbers, schedules, and other data.
  • Use the App lawfully. Do not use the App for any illegal purpose or in violation of your probation terms.
  • Verify with your PO. If you are ever unsure about a check-in result or requirement, contact your probation officer directly.

5. Accounts & Security

When you create an account, you agree to:

  • Provide accurate and complete information
  • Keep your login credentials secure and confidential
  • Notify us immediately if you suspect unauthorized access to your account
  • Be responsible for all activity under your account

6. Subscriptions & Payments

Probation360 may offer a free trial and/or paid subscription plans:

  • Free Trial: If offered, you can use the App at no cost for a limited period.
  • Auto-Renewal: Paid subscriptions automatically renew unless you cancel before the renewal date.
  • Cancellation: You can cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period.
  • No Refunds: Subscription fees are non-refundable except as required by law or Apple's policies.

7. No Guarantees of Results

We work hard to make the App reliable, but we cannot guarantee:

  • The App will always be available or error-free
  • Reminders will always be delivered on time
  • Check-in results or data will always be accurate
  • Using the App will ensure you meet your probation requirements

The App is a convenience tool. You are responsible for your own compliance.

8. License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on a device you own or control
  • Use the App for your personal, non-commercial purposes

This license does not allow you to:

  • Copy, modify, adapt, or create derivative works of the App
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code
  • Rent, lease, lend, sell, sublicense, or distribute the App to third parties
  • Remove, alter, or obscure any copyright, trademark, or proprietary notices
  • Use the App for any commercial purpose without our written consent
  • Use any robot, spider, crawler, or automated means to access the App

We reserve all rights not expressly granted in these Terms.

9. Acceptable Use

You agree not to:

  • Use the App for any illegal or unauthorized purpose
  • Attempt to hack, reverse-engineer, or tamper with the App
  • Scrape, copy, or extract data from the App
  • Interfere with the App's operation or other users' access
  • Share your account with others or create multiple accounts
  • Use the App in any way that violates your probation or parole terms
  • Transmit viruses, malware, or other harmful code

10. Intellectual Property

Probation360 and its licensors own all rights, title, and interest in the App, including all intellectual property rights. This includes the App's name, logo, design, user interface, features, content, software, and documentation. All trademarks, service marks, and trade names are the property of Probation360 or their respective owners.

11. Third-Party Services

The App may link to or integrate with third-party services (such as UA hotlines, testing centers, or external websites). We are not responsible for:

  • The availability, accuracy, or reliability of third-party services
  • The content, policies, or practices of third-party websites or services
  • Any transactions or interactions you have with third parties

Your use of third-party services is governed by their respective terms and privacy policies, and is at your own risk.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or completeness of information

We do not warrant that the App will meet your requirements, be uninterrupted, timely, secure, or error-free, or that defects will be corrected.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROBATION360 AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any missed check-ins, tests, or probation requirements
  • Any probation violations, revocations, or legal consequences
  • Any indirect, incidental, special, punitive, or consequential damages
  • Any loss of profits, revenue, data, or business opportunities
  • Any loss of data, unauthorized access, or security breaches
  • Any damages arising from your reliance on the App

Our total aggregate liability for any and all claims shall not exceed the greater of: (a) the amount you paid us in the 12 months before the claim arose, or (b) fifty dollars ($50 USD).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Probation360 and its officers, directors, employees, agents, affiliates, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Your violation of any third-party rights
  • Any content or data you submit through the App

15. Termination

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or engaged in harmful conduct. You may delete your account at any time through the App settings or by contacting us.

Upon termination:

  • Your right to use the App ends immediately
  • We may delete your account data (subject to our data retention policy)
  • Sections that by their nature should survive (including disclaimer, limitation of liability, indemnification, and arbitration) will remain in effect

16. Binding Arbitration & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Agreement to Arbitrate

You and Probation360 agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App (collectively, "Disputes") will be resolved exclusively through binding individual arbitration, rather than in court, except that:

  • You may assert claims in small claims court if your claims qualify
  • Either party may seek injunctive or equitable relief in court for intellectual property infringement

Class Action Waiver

YOU AND PROBATION360 AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

Arbitration Rules

Arbitration will be conducted by JAMS under its Streamlined Arbitration Rules and Procedures (or, if applicable, its Consumer Arbitration Rules). The arbitration will be held in Delaware, or another location mutually agreed upon. The arbitrator's decision will be final and binding.

Opt-Out

You may opt out of this arbitration agreement by sending written notice to legal@probation360.app within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of the arbitration agreement.

17. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. For any matters not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Delaware.

18. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and Probation360 regarding the App.
  • Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.
  • Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.
  • Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations freely.

19. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through the App or by email at least 30 days before taking effect. Your continued use after changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the App.
